Es natural que cuando una pareja decide contraer matrimonio no piense en cómo será su divorcio. Sin embargo, considerando que es una posibilidad, es importante que quienes deciden casarse tengan claro desde el principio cómo se distribuirán los bienes, para no sumar dolores de cabeza adicionales al de por sí difícil trámite de la separación.
Lo primero que hay que tener en cuenta es que, a menos que se pacte algo diferente, el matrimonio da lugar al nacimiento de una sociedad conyugal. “El principio esencial es que si no se hace nada, va a surgir a la vida jurídica la sociedad conyugal, o la sociedad patrimonial en el caso de las uniones libres. Sin embargo, es posible pactar algo diferente antes del matrimonio”, dijo el experto en derecho de familia Evans Bermúdez.
Una posibilidad para esto es firmar capitulaciones, un acto jurídico que en el que los esponsables, es decir, los prometidos, fijan el régimen de los bienes que harán o no parte de su sociedad conyugal. “Este acto debe llevarse a cabo mediante escritura pública, siempre debe realizarse antes del matrimonio y lo allí pactado no se puede modificar una vez las personas contraen matrimonio”,
